Molly Ann Farms, LLC (“Molly Ann Farms,” “we,” “us,” or “our”) respects the privacy of our customers, website visitors, loyalty program members, and other individuals who interact with us (collectively, “you” or “your”). We recognize that the cannabis industry carries unique sensitivities due to its legal history and evolving societal context, and we are committed to transparency regarding the collection, use, disclosure, and protection of personal information.
This Privacy Policy is intended to comply with applicable laws and regulations of the State of New Jersey and governs all data processing activities conducted by Molly Ann Farms.
1. Information We Collect
We may collect the following categories of information:
- Identification Information. As required by law, we verify government-issued identification (such as a driver’s license or passport) of all patrons in order to confirm age and eligibility.
- Transaction Information. We record purchase history associated with your account or loyalty membership. If you request anonymous checkout, your purchase history will be de-identified and not linked to your personally identifiable information.
- Contact Information. When you participate in our loyalty program, promotions, or communications, we may collect your name, phone number, email address, mailing address, or similar information.
- Surveillance Information. Pursuant to New Jersey Cannabis Regulatory Commission requirements, our premises are under continuous 24/7 video surveillance. Footage is retained for at least thirty (30) days and may be accessed by local or state officials.
- Website & Marketing Information. Through the use of cookies and similar tracking technologies, we may collect information about your browsing behavior, marketing interactions, and device identifiers.
2. How We Use Information
We use the information collected for the following purposes:
- Regulatory Compliance. To satisfy New Jersey state cannabis laws and regulations, including ID verification and surveillance requirements.
- Operational Support. To facilitate store operations, transaction processing, fraud prevention, and customer service.
- Personalized Services. To reference past orders, provide tailored recommendations, and improve the customer experience.
- Marketing & Loyalty Programs. To communicate offers, events, and promotions by email, text message, phone, in-app notifications, or direct mail. By enrolling in our loyalty program, you consent to receiving marketing through at least one channel of communication.
- Business Management. To conduct staff training, remote monitoring, quality assurance, issue resolution, and other lawful business functions.
3. Disclosure of Information
We do not sell customer information. We may disclose information only as follows:
- Vendors and Service Providers. We share information with our third-party software platforms, Blaze, Inc. and Alpine IQ, for the purposes of managing compliant store operations, loyalty program management, and marketing services.
- Regulators and Law Enforcement. We will not disclose personally identifiable customer information to government authorities voluntarily. Disclosure will occur only upon receipt of a valid subpoena, court order, or as otherwise required by law.
- Cookies and Ad Partners. We permit third-party cookies to measure campaign effectiveness and provide retargeted advertising.
4. Data Retention
- Surveillance footage is retained for a minimum of thirty (30) days, in accordance with regulatory requirements.
- Transaction and account records are retained as long as necessary to fulfill legal obligations and provide services, unless deletion is requested in accordance with Section 6 below.
5. Your Choices
- Anonymous Checkout. Customers may request anonymous checkout at the time of purchase. This prevents linking of purchase history to personally identifiable data.
- Marketing Communications. You may opt out of specific channels of marketing communication at any time by following the opt-out instructions contained in the message or by contacting us directly. Please note: redemption of loyalty points requires you to remain subscribed to at least one communication channel.
- Cookies. You may modify browser settings to decline cookies, though this may affect your experience on our website.
6. Data Deletion Requests
If you would like us to delete your personally identifiable contact information, you may submit a deletion request. For security and verification, we require such requests be made:
- In Person. At our store, with presentation of valid government-issued identification; or
- At a Nearby Business Location. If you wish to avoid being recorded on surveillance video, we will arrange to validate your identity offsite prior to processing your deletion request.
We will process all valid deletion requests in a timely manner, subject to legal and regulatory data retention requirements.
7. No Medical Records
Molly Ann Farms operates solely as an adult-use recreational dispensary. We do not collect, access, or process any patient medical information maintained by the State of New Jersey or any other medical entity. Accordingly, the federal Health Insurance Portability and Accountability Act (“HIPAA”) does not apply to our operations.
8. Security
We implement commercially reasonable physical, electronic, and administrative safeguards designed to protect personal information against loss, misuse, and unauthorized access. However, no security system is impenetrable, and we cannot guarantee absolute security of information.
9. Changes to This Policy
We may update this Privacy Policy from time to time. Any material changes will be posted on our website with an updated effective date. Your continued use of our services following such changes constitutes acceptance of the revised policy.
